Rick, I am the one feeling like an idiot now. I covered my short at the beginning of the last up spike expecting to short again on a year end spike up in response to a ZixCharge contract announcement and a split. But based on this news, I seriously doubt that I will get the opportunity. Looks like they failed to get any significant business and I doubt their pockets are deep enough to prevail in a legal battle with VISA even if they are right. I think I missed the boat!

But as I have pointed out on SI before, shorts must always be very careful in their posts. Unless you are an insider, you can post any lie you want in favor of the company and there is no one to sue you. But the company can sue you for negative posts and give you a great deal of trouble even if the posts are true. And the use of, or implication of, profanity in your posts is going to go against you, your intentions, and your credibility big time in a legal forum. Long or short, there is no purpose or good from profanity in a public forum and a jury might choose to punish you for the profanity disregarding other evidence! While VISA is not likely to be harmed by the legal battle, some individuals could be.

My wish for 2000 is that all posters on these boards will make, and keep, a resolution to cease posting profanity and stick to debating the merits of company products and strategy.

It has also been my observation that companies who file suit over negative posts are almost always good shorts.
