Let's assume that this charade actually goes to court. The plaintiff, ZIXI's beloved CEO, gets to explain to open court why he promised agreements by 12/31 and didn't deliver (because of the evil VISA conspiracy?). Not the most credible witness, perhaps.

No SI posters named at all. I doubt we need to sweat much. And an opinion regarding a CEO's ability to fulfill a promise made in a press release is First Amendment all the way, IMHO.

For those who don't get to be defendants, ZIXI is still a terrific long-term short. They have trashed their credibility with the financial transaction industry. Little upstart companies that sue major players won't find many open doors later.

All just my un-expert opinion. But I canceled my ZIXI stop and plan to be in this small short position until it is worth much more to my account. I would add more but shares are probably getting hard to find.

None of R's sophistry and semantics will change the facts.
