By characterizing the press coverage as "leaks," Ballmer confirms, to some extent, that they reflect what is going on (which he undoubtedly knows via the settlement discussions). More neutral comments might have been "no comment" or "the press is purely speculating about the nature of the talks, which are secret."

A point to ponder. If it could be proven that the leaks were deliberate, and that at any point in time this reduced shareholder value, could the shareholders file a class action lawsuit against the DOJ? I imagine a suit in the amount of a hundred billion dollars or so might get someone's attention.
