Don't be too suprised if Lexar tries a flurry of these nonsense legal manuevers going to into Oct. 23.

Remeber, Lexar is a company fighting for its life, and Lexar Management has proven themselves to be very aggressive in every aspect of running their company. I like Lexar Management. They are sharks who let NOTHING stand in the way of their company. A plus in my book. Stealing other people's technology aside.

But soon, Lexar as a company very likely will be no more. Until then, expect the Lexar Sharks to keep flailing around in the chum at an ever increasing rate. SNDK could take a beating in the meantime, as Lawsuits are bad news period and affect stock prices (even if they are found to have no merit). This is just another move by the Lexar Sharks to try and get a little even with Sandisk by trying to punish their stock.

In response to a few of the questions you have posed, I have some answers and my own analysis to offer.

But, if you will bear with me, first a joke that my father used to tell. He was a reformed lawyer, but he knew that the purpose of most law suits is simple--delay.

A young man graduates from law school and joins his father's firm. The youngster is assigned to research a minor aspect of the firm's biggest suit. After a few months the son comes into his father's office and says proudly, "Dad. Guess what?! I settled the Brown case."

His father looks at him incredulously. "You did what?" he storms.

"I got the sides to agree. I settled the Brown case. Everybody is happy."

"You idiot," the father bellows. "Our family has been living off the Brown case for two decades."

I know there are several lawyers who follow our thread, and I suspect they will relate to the joke.

The point is that Lexar is in desperate straights. They Lexar engineers are currently trying to design their way around the serious Sandisk patents. Chances are they have run into problems with that task, and they need more time. So the Lexar management goes to their ace attorneys and says, "We need more time. You must delay." That's my analysis of this latest lawsuit.

As to your question about the Delaware filing, many large corporations are incorporated in Delaware, because that state has favorable laws. Then there is the added benefit of trying to hold the trial where it makes life difficult for the other side. If Eli and several other key Sandisk engineers have to spend a lot of time in Delaware courts, Sandisk's own R&D will suffer considerably. It's just one more arrow in a lawyers bag of tricks to try to force the other side to settle.

I've said it before and I'll say it again. This is TRADING season. Sandisk, the SOX and the NASDAQ in general go up and down almost at random, in case you haven't noticed. Investing season starts in OCTOBER .

As for news of the bogus LEXAR suit, it isn't moving the stock one way or the other. Volume is normal. Market is down, so Sandisk is down. When the market goes up, Sandisk will go up. This isn't rocket science.

As for a split, come on now! Not at 80 or 90 per share. In fact, I think it would be more beneficial if the company did a reverse 2 for 1 split. That way, each share would be worth twice as much! Think about it. <gg>

We will see SNDK bottom between the 3rd week in Sept and the end of October. Then the fund managers will come in and we will get a meaningful move. In the meantime all this talk about price movement, news, Lexar, MP3 stuff, is much to do about nothing. Lets get our attention off the ripples and concern ourself with the tide.

While we are waiting, Aus, don't get your left hand get mixed up with your right. Dyslexia can be very unpleasant for analyst, I imagine. <g>

OT. Does anyone know of a reliable online sports betting web site? Would appreciate if anyone has personally used one that they are happy with. Post or send me a PM soon, please. Or do any of the Big Vegas sports betting casinos take bets over phone from California? I can't believe that the RAMS are only favored by 8 against SEAHAWKS! Seahawks were shut out in their opener. The only way the RAMS won't cover the spread is if they they travel to Seattle on a Concord equipped with Firestone tires. I know this is way off topic, but it seems like a good investment to me. If I can get bet down on this I can pay for a NIKON 990 which by the way is down to $839. Please let me know. Thanks.
