Sorry investor Rock <g>. I find it's hard to fail the daytrader test from the article, except test 1 from part II: "actually make money after all deductible expenses" <ggg>

My accountant was calling the IRS about test 2 part II: "no regular full-time job or profession," since I trade for my clients as full-time, but I also trade for myself as well. After seeing more than 1000 trades I had made last year in my personnal account, they made her wait for 20 minutes and said it's OK.

98%? you're kidding, right. It's a nightmare if one has to check on every trade for wash sale when one traded more than 500 trades per year.
