To answer this difficult question, next time you are going out with the guys for a few beers, ask your wife....."honey, is adultery committed only when penetration is involved?". She will likely be able to give you a clear and concise answer. If you don't think it would be a good idea to ask your wife, consider if your wife was going out with the girls and asked you..... "sweetheart, is adultery committed only when penetration is involved?" What would your answer be?

Only thing I can say is : we all (well, most of us at least) possess within us the ability to analyze facts correctly and come out with conclusions we believe with our hearts and souls.

What makes things complicated is when we allow our wish for a desired outcome color our judgments and analysis. This applies to many things --- our sense of fair play, those damn chads, and what bill did. It can apply to me, you, them, anyone that is human, and most of us don't even know it is happening.

Anyway, rmbs has been beaten down like many others, I wonder how the things may fall. Perhaps judges can be unconciously subjective too, which makes court rulings always tricky to predict.

Somedays, we should just be ruled by a giant computer and get wireless 1394 transceivers hooked up to our brains. (Just kidding). Any election will take less than a second to count and tabulate, and recounts will yield exactly the same number everytime.
