Pricing controls are not illegal. Indeed, the U.S. government itself established the minimum prices that Japanese DRAM vendors could charge for 1MB DRAM and in Pennsylvania, as well as many other states, there are minimum milk prices as well as minimum cigarette prices.

Alcoa Aluminum regularly checks with Reynolds Aluminum to insure that they are not pricing Reynolds out of the market. They do this to avoid becoming a monopoly in the aluminum business.

Pricing controls are only illegal if they tread into antitrust and/or RICO territory.

Obviously I chose the wrong wording, yes pricing controls are illegal, but a non-compete clause isn't. I am not a lawyer so I can't go into a detailed dissertation of contract law but I stand by my assertion that Cyrix was the victim of their own hand in the matter.

PS: It is heartwarming to me that TSMC is so noble (or so you claim) but you never answered my question about what you would do if you found the merchandise that you took in lieu of cash payment to be difficult to sell. IBM sold it for what they could get, I would have done the same, and despite what you say I would wager that TSMC would too... What would you have done? (remember you are accountable to your shareholders)
