Really, Sir, you most assuredly must be joking. Are you serious? Now do you really believe you can squelch, quash and block reasonable, legitimate and fair inquiry and discussion of companies and individuals who have been using and abusing SILICON INVESTOR and its Membership in flagrant violation of Silicon Investor’s very own anti-advertising TOU rules for several years, actually incorporating SI into their own sites, while allowing despicable attacks, as found in the following, to go their merry way?

Kudos to you, Sir, for your non-responsive attitude to date, are completely out of order. Thus far, you have failed to provide any answer. I would greatly appreciate an immediate response here in public.
Eerily, what we have here, Sir, are many SI Members in otherwise good standing in this community, witlessly ejected from SI, and then this thread, though humorous and in many respects quite accurate, containing a number of posts which strike one as more conjecture than fact, relative to what I and others have posted at SI on these issues, somehow at the same time remaining within TOU guidelines. That is quite curious, indeed. Through what reasonable lens could this indefensible position have been maintained? Many statements here, which, according to your very own convoluted justifications and definitions of “personal attack” and “harassment” seem to go far further down that line than any we have offered this forum, have been permitted to stand without any sanction whatsoever - until now. Of course, on the other hand, I imagine banning 100 SI Members en masse would raise a few eyebrows. However, that did nevertheless not stop you from banning and suspending the Membership Rights and Privileges of Tim Luke, DrMensaWannabe, bob and myself a great many times the past six months, for daring to question some of the practices taking place at SI. My response to that is the same as it has been for quite some time now: By what right do you take these actions? We are all paid Members of this service. We may reasonably expect that you enforce your binding TOU guidelines in a fair, even-handed and responsible manner, and that you NOT use your position of authority, responsibility and trust to obfuscate, distort, cloud, cloak or otherwise manipulate fact and truth through this medium.
To now, Sir, this thread was “allowed” – as you so oft have characterized free speech rights, as some kind of luxury to be suspended or revoked at your fickle whim - to exercise its inalienable and contractual right to free speech for a full week and over 500 posts, until the following post was made:

I was taking a look at the hot list to see what kind of threads exist on Silicon Investor.
It has been a real eye opener.
I saw that Terra Nova sponsors the hot list. Is that the same Terra Nova that got a Cease and Desist Order from the Ohio Division of Securities Order No. 98-322 to which Terra Nova knowingly and voluntarily waived the right to the adjudicative hearing and entered a consent agreement?

A post is made informing SI Members of the disturbing regulatory history of one of its chief sponsors, TERRA NOVA TRADING, L.L.C., an admitted securities law violator, and poof! on comes SI ADMIN immediately, attempting to squelch, stifle and block a free and open discussion forum, ordering about, directing and censoring its members. (This SI Member, petite lambette, has been rewarded for these comments with immediate suspension.) After more than 137 hours – or 8,186 minutes to be precise - and over 500 posts, no more than 53 minutes after that post censorship is yet again initiated by SI Admin as the Order of the Day. Et quelle coincidence frappante, the timing of SI Admin. It leaves quite an impression, this form of behavior, my dear Sir. Quite an impression indeed…
Essential it is, Sir, in an open discussion forum, for candor to reign supreme. Therefore, I would wish to inform any SI Members unaware of these issues, that the brokerage firm Terra Nova Trading, L.L.C. is a prominent sponsor of Silicon Investor. This brokerage firm sponsors the HOT LISTS at SI. These are lists which purport to be an accurate record of the popularity and activity of threads on the SI message boards. They are designed to reward, honor and lend prestige to the most active discussion groups – or at least that is the implication given and representation made to the SI Membership. Yet, there have been grave questions raised here concerning those lists, and whether they are being used to INTENTIONALLY MISLEAD and DECEIVE the SI Membership, whether they are being DELIBERATELY MANIPULATED to give the appearance of popularity to a few commercial threads run by companies with financial ties to Terra Nova Trading, L.L.C. SI thus far has refused to comment upon or respond to this issue. Why? Many members have posed these questions now, for several weeks.
Regret is an emotion with which I now feel compelled to ask the directors and employees of this service some difficult questions. Would SI care to comment on the following, evidence that one of its more prominent sponsors, Terra Nova Trading, L.L.C. has been sanctioned by the State of Ohio, Division of Securities, for flagrant violation of securities laws, by operating in that state as a broker-dealer without having a license? Surely Silicon Investor and its parent company, INFOSPACE, INC., are aware of this? If not, you are now, and let us be very clear now: here, Terra Nova Trading, L.L.C. openly and freely admits to its GUILT in violating the securities laws of the State of Ohio. Inquiries, a great many of them, Sir, are now tabled. It is time you and Silicon Investor came clean about the kinds of business arrangements you have with the admitted securities law violator Terra Nova Trading, L.L.C. and why you are clearly favoring and shielding employees of companies, such as PRISTINE CAPITAL MANAGEMENT, INC. and its subsidiary MARKET GEMS, who have commercial ties to them. We as paid Members of the service SI provides deserve, expect and demand a timely and adequate explanation.
Now I wonder, Sir if you realize that both Silicon Investor and its parent Infospace, Inc.. and their DIRECTORS AND EMPLOYEES, can be held jointly and severably liable for any damages accruing from any unlawful actions performed by such companies operating here at SI, if it can be shown that unlawful or otherwise contractually breaching agreements contrary to the best interests of SI Members between Silicon Investor/Infospace and any of these companies were effected and carried out, while failing to be properly disclosed to the Membership of this site? Are you aware that if it is proven that you actively engaged in protecting the standing of your commercial PARTNERS, while denying a number of aggrieved parties their contractual right to freely voice their opinions here, a site that you represent as an implicitly free, open and uncensored discussion forum, that you may likewise be held liable for any and all damages accruing from such activity? Again, considering what we have seen here recently, I truly wonder. No matter - that is the law, and ignorance thereof is not a defensible position available to you.
Great trepidation I have, Sir, that many here are not quite clear on these matters, however. BREACH-OF-CONTRACT, TORT, TORTUOUS INTERFERENCE, SECURITIES FRAUD, CONSPIRACY TO DEFRAUD, RACKETEERING VIOLATIONS – these are but a few of the many charges that have been alleged concerning certain companies operating with apparent impunity through the message boards owned and operated by your company. I would hope and expect that you have not made any UNDISCLOSED AGREEMENTS that would interfere with your contractual obligations to your Members, or that would fall afoul of State and Federal securities laws – or any other civil and criminal codes, for that matter. If, in spite of all good-faith representation made by you to your Members upon payment by those same faithful Members of Membership Fees securing the Rights and Privileges of Silicon Investor Membership, it comes to light that you have contracted Undisclosed Agreements contrary to the best interest of your Members with these firms, the unequivocal statements to the contrary made by your CHIEF EXECUTIVE OFFICER, MR. BUSBY here notwithstanding, then I fear we have a very serious problem.
? is a question mark, Sir, and above the Silicon Investor landscape at the moment I see a great many of these. Rank silence, if not intentional or deliberately negligent, is very unwise. The more you avoid these questions, the more SI Members – those whom you have not peremptorily ejected from this arena - shall continue to question what is going on here. It is time for some clear answers to our many questions.
I would offer you, Sir, and everyone here and across Silicon Investor evidence indicating the likelihood that, as many of us here now suspect, these Hot Lists are being DELIBERATELY and INTENTIONALLY MANIPULATED: one minute NEW Market Ideas – Weird Opinion Trades is top of the list, one minute it suddenly and completely disappears from view, then the next it miraculously re-appears – but only after a number of SI Members have commented on this strange turn of events in public.
Then, all the while we see at the very top of the list a thread conceived by a company which has garnered a massive proportion of its corporate revenues from activities performed here through SI, NEW Market Gems – Swing and Day Trades. This thread was established and is operated by a company which is now a subsidiary of PRISTINE.COM, a website engaged in the business of giving INVESTMENT ADVICE, owned by PRISTINE CAPITAL MANAGEMENT, INC., which owns and operates the broker-dealer, THE EXECUTIONER, L.L.C., an affiliate of Terra Nova Trading, L.L.C. The Market Gems subject is a thread in which 95% of all posts are made by a single SI Member and employee of Pristine, MS. BARBARA SIMON a.k.a. ”JENNA”, a woman who has openly LIBELED and DEFAMED a number of SI Members who dared question her activities. Thus, while many of those who have been so attacked have had their SI Membership Rights and Privileges revoked without any explanation, this company’s specifically TOU-prohibited advertising service here at SI is #1 on the Terra Nova Trading, L.L.C.-sponsored Hot List – with but one single post the entire day. “Hot”? Perhaps we who presently behold these lists in such confusion mistakenly refer to the wrong definition of the word. Perhaps we should be using the colloquial definitions, such as in hot rod, (i.e. souped-up or rigged) or truckload of hot servers (i.e. the proper ownership of which is stolen). Hot tamale? Maybe, for anyone who may be involved, if these allegations prove true.
I would also offer that there are grounds to question whether Silicon Investor and its directors and employees have acted with GRATUITOUS and INTENTIONAL MALICE in denying certain Members their Membership Rights and Privileges as a direct result of perceived obligations pertaining to undisclosed agreements made with certain companies operating through the Silicon Investor message board service.
Only you - or a court of law - are empowered to offer us a definitive answer to these many questions, and I expect a great many SI Members would join me in demanding an immediate explanation from you.

Note to all Silicon Investor Members: though a medium such as this one on the Internet gives a company such as Infospace, Inc. and its Partners great power and sway over individuals and their rights, a vast opportunity to abuse this position of trust, it is also true that statements and actions which have taken place both here and elsewhere are also quite easily monitored, recorded and traced. That means that if any damages have taken place here at SI, those who are responsible will be quite easily identified. Those of you who have DELIBERATELY SCHEMED against and DECEIVED SI Members through MANIPULATIVE DEVICE and ARTIFICE, multiple SI Memberships and such as the reprehensible and dishonest practice of establishing aliases, shall not be able to hide much longer.

STATE OF OHIO DEPARTMENT OF COMMERCE DIVISION OF SECURITIES COLUMBUS, OHIO 43215 Order No. 98-322 IN THE MATTER OF: TERRA NOVA TRADING, L.L.C. Ohio License No. 210605 CEASE AND DESIST DIVISION ORDER WHEREAS, the Ohio Division of Securities (hereinafter alternatively referred to as "Division") is charged with the responsibility for protecting investors and finds that this Order is necessary or appropriate in the public interest or for the protection of investors, and is consistent with the purposes fairly intended by the Ohio Securities Act, R.C. Chapter 1707; WHEREAS, on or about February 11, 1998, Terra Nova Trading, L.L.C., (hereinafter alternately referred to as "TNT") through the Central Registration Depository of the National Association of Securities Dealers, Inc., (hereinafter alternately referred to as "NASD") made application to the Division for licensing as a dealer of securities; WHEREAS, the Division has conducted a review of the application of TNT, whose address is 100 South Wacker Drive, Suite 2012, Chicago, Illinois 60606, Ohio License No. 210605, for a license as a dealer of securities issued by the Division, and as a result of that review, the Division finds as follows: (1) On or about November 22, 1994, an Ohio limited liability company was formed under the name Terra Nova Trading, L.L.C. TNT has maintained a business address at 100 South Wacker Drive, Suite 2012, Chicago, Illinois 60606. (2) TNT is not now licensed as a securities dealer in Ohio under the authority of the Ohio Securities Act, Chapter 1707 of the Revised Code. (3) On or about February 11, 1998, TNT submitted information to the Division by way of the Central Registration Depository of the NASD to initiate an application for licensing as an Ohio securities dealer in accordance with R.C. 1707.15 and O.A.C. 1301:6-3-15. (4) On or about June 3, 1998, the Division received notification from Terra Nova Trading, L.L.C., that TNT had operated in Ohio as a securities dealer during the period from January 2, 1998, through May 5, 1998, and that TNT had effected transactions on behalf of approximately nine Ohio residents during that period. (5) R.C. 1707.01(C) provides: (C)(1) "Sale" has the full meaning of "sale" as applied by or accepted in courts of law or equity, and includes every disposition, or attempt to dispose, of a security or of an interest in a security. "Sale" also includes a contract to sell, an exchange, an attempt to sell, an option of sale, a solicitation of a sale, a solicitation of an offer to buy, a subscription, or an offer to sell, directly or indirectly, by agent, circular, pamphlet, advertisement, or otherwise. (2) "Sell" means any act by which a sale is made. (3) The use of advertisements, circulars, or pamphlets in connection with the sale of securities in this state exclusively to the purchasers specified in division (D) of section 1707.03 of the Revised Code is not a sale when the advertisements, circulars, and pamphlets describing and offering those securities bear a readily legible legend in substance as follows: "This offer is made on behalf of dealers licensed under sections 1707.01 to 1707.45 of the Revised Code, and is confined in this state exclusively to institutional investors and licensed dealers." (4) The offering of securities by any person in conjunction with a licensed dealer by use of advertisement, circular, or pamphlet is not a sale if that person does not otherwise attempt to sell securities in this state. (5) Any security given with, or as a bonus on account of, any purchase of securities is conclusively presumed to constitute a part of the subject of that purchase and has been "sold." (6) "Sale" by an owner, pledgee, or mortgagee, or by a person acting in a representative capacity, includes sale on behalf of such party by an agent, including a licensed dealer or salesman. (6) R.C. 1707.44(A) provides that "no person shall engage in any act or practice that violates division (A), (B), or (C) of section 1707.14 of the Revised Code, and no salesperson shall sell securities in this state without being licensed pursuant to section 1707.16 of the Revised Code." (7) R.C. 1707.14 provides, in pertinent part at paragraph (1) of division (A) of that section: "No person shall act as a dealer, unless the person is licensed as a dealer by the division of securities." Whereas, pursuant to R.C. Chapter 119, on August , 1998, the Division issued and subsequently served on Terra Nova Trading, L.L.C., Division Order No. 98- , Notice of Opportunity for Hearing, which sets forth the information contained in Paragraphs 1 through 7 above; Whereas, pursuant to R.C. Chapter 119, the Notice of Opportunity for Hearing, Division Order No. 98-321, was mailed by Certified Mail, Certified Mail No. P 123 964 380 to Terra Nova Trading, L.L.C., at its last known address; WHEREAS, in response to discussions between the Division and Terra Nova Trading, L.L.C., the Division and Terra Nova Trading, L.L.C., have entered into a Consent Agreement, which is attached hereto as Exhibit A and incorporated herein by reference; WHEREAS, in response to discussions between the Division and Terra Nova Trading, L.L.C., Terra Nova Trading, L.L.C., has undertaken to offer rescission in accordance with R.C. Chapter 1707 to purchasers in the sales described in Paragraph 4 above, and to purchasers in all sales made in violation of the Ohio Securities Act during the period from January 2, 1998, through, and including, the date of the issuance of the license under the terms of an Undertaking, which is attached hereto as Exhibit B and incorporated herein by reference; and WHEREAS, based upon Paragraphs (1) through (7), the Division finds that Terra Nova Trading, L.L.C., has violated the provisions of R.C. 1707.44(A). THEREFORE IT IS ORDERED THAT, pursuant to R.C. section 1707.23, Terra Nova Trading, L.L.C., CEASE AND DESIST from the acts and practices as described above which constitute a violation of R.C. Chapter 1707. NOTICE OF APPEAL RIGHTS: TERRA NOVA TRADING, L.L.C., IS HEREBY NOTIFIED THAT THIS ORDER MAY BE APPEALED PURSUANT TO R.C. 119.12 BY FILING A NOTICE OF APPEAL WITH THE OHIO DIVISION OF SECURITIES, SETTING FORTH THE ORDER APPEALED FROM AND THE GROUNDS OF THE APPEAL. A COPY OF SUCH NOTICE OF APPEAL SHALL ALSO BE FILED WITH THE FRANKLIN COUNTY COURT OF COMMON PLEAS.
