I could see him saying he was not fighting against the USA but against the Northern Alliance only in a civil war. As far as I know there has not been a a declaration of war by Congress against Afghanistan, only a lot of rhetoric calling it a war.

Sounds like treason to me, as well, but I'm more interested in finding out what was going on in his head than in punishing him. To the extent that we can do both, great. To the extent that prosecuting him impedes putting him under a microscope, I'd favor the microscope to the brig.

I guess the question is, has he taken up arms against the United States? From what I have heard, he was fighting with the Taliban against Northern Alliance forces.

(I'm not taking the guy's side in this, just playing devil's advocate)
