I could see him saying he was not fighting against the USA but against the Northern Alliance only in a civil war. As far as I know there has not been a a declaration of war by Congress against Afghanistan, only a lot of rhetoric calling it a war.

sounds like treason to me Sounds like treason to me, as well, but I'm more interested in finding out what was going on in his head than in punishing him. To the extent that we can do both, great. To the extent that prosecuting him impedes putting him under a microscope, I'd favor the microscope to the brig. Karen P.S. There's still the possibility that the guy was a CIA mole or some such.
