You keep analogizing in your mind to the criminal justice system, but the situation as we see it is war. No due process, no presumption of innocence, no jury, no lawyers, no cushy jail cells.

Death to Al Qaeda. These guys are dead men walking.

If they want justice and mercy, they can surrender.

The BBC link did mention they had been watched for months.

but Yemeni officials said he had been under surveillance for months and intelligence had been passed on to the Americans.

The moral of the tale is that you don't fight the USA with violence. The Vietnamese only won because of the "limited war" aspect, they paid a huge price in human terms too.

If the Muslim world want to redress wrongs by the USA (I would put Multinationals on the list) then true democracy is a most potent weapon. The Muslims have lots of guys who can vote.
