Is a fetus 5 weeks before full term a person?

How would you define person?

An embryo is a living member of the species homo sapiens. It is not only human (a human fingernail is human) but it is a human. "Person" might be a little bit more complicated, but I am certain about the "a human" part.

What defines a person.

Nofe that over the year, various forms of human protoplasm we now consider persons were not persons in the sense of being afforded full legal rights. Some of those classes include homosexuals, jews, woman, blacks, American Indians, Chinese, Japs, Krauts, and on and on.

So start by defining what a person is, for purposes of applying the equal majesty of the law (since what we're talking about in the end is a legal issue, not a moral one.)
