And let me point out that the murder was without the consent of the mother........it was an unlawful invasion of her right to privacy and her right to control her own body. Therefore it is not the equivalent of abortion.

Hear that Steve and Ten?

Hear what? Murder is only legal with the consent of the mother?

Just a moment now: You say that murder of the mother would also be murder of the fetus because it usually cannot survive without the mother, right?

Thus you do agree that a fetus can be murdered, at least indirectly (collateral damage, eh?).
Assuming you having said that a fetus can be murdered, how do you distinguish between the termination of the fetus by abortion only (not murder) or by other means (murder) like above?

A fetus killed by action of a human thus sometimes is murder (you get the needle) and sometimes is abortion only (lawful), all according to the circumstances, right?

He wasn't charted with "unlawful invasion of her right to privacy". He was charged with murdering her, and with murdering the fetus. But again the law is not always consistent.
