When teenagers spray paint a Nazi swastika with the words "die Jews" on a synagogue, this is an altogether different crime. This is a hate crime.

That's "free speech." The graffitti is a crime. What they say isn't. I know I am in the minority on this issue.

When teenagers spray paint random graffiti on the façade of a bridge, this is a crime of vandalism. When teenagers spray paint a Nazi swastika with the words "die Jews" on a synagogue, this is an altogether different crime. This is a hate crime

Nope, it's vandalism with hateful motive which can enhance the sentence.

If a statute tried to criminalize saying or writing "die Jews", it might not survive the courts because it is criminalizing content of speech, not conduct.

It's a messy area to be tiptoeing around in.

Not exactly a surprise that a gay rights organization comes out in favor of hate crime legislation.

If there is a clause in the Constitution that you believe supports additional sanctions for group hatred as opposed to the illegality of the actions themselves, perhaps you would point it out.

Depending on exactly how the issue is phrased, I would hazard a guess that LB is not in the minority on this issue after all.
