The point to me is not even about this president. It is about the system we have and about checks and balances and about under what circumstances a president has the right to sidestep the system of checks and balances. To me it is a given that a system that fails in it's checks and balances will become corrupt. We need to preserve the checks and balances. We minimize them at our peril.

Even if Rexley is clean, and she speaks to someone known to be a terrorist on the phone, then her phone should be tapped.

Look, where do you want to split the hair? I say that if you have evidence of terrorism on either end of the phone, that's good enough. All you need now is the warrant.

You are not the FISA judge...you cannot give Bush approval...but if you want to wire tap an American Citizen, then the law is clear...you need Judicial review and approval.
