The power to decide constitutionality is exclusively given to the judicial branch in the Constitution. Given that, there would have to be some clause that allows the executive to decide constitutionality. There isn't. Therefore, you are claiming something that isn't supported by the Constitution.

He doesn't need any authority to decide constitutionality in order to follow the constitution, just as when there is no constitutional issues he doesn't the powers granted to the judicial branch in order to interpret and follow statute law. In either case he can be overruled by the courts.

Nonsense. Only a judge can interpret a law in order to determine constitutionality.
