Whatever evidence they have, they will now be able to get sworn testimony in depositions and at trial, as well as discovery of documents from all members of Project Stockholm Group and their common PR firm. Since the matter is now pled and at issue, all tools of court enforced discovery will be available to them.That could prove interesting.

Yes, but I'm just hoping that they have reason to believe that such an alliance occurred beyond the single email. It may be from some off the record talks within the industry or something else entirely, but if this is based on just an instinct that there much be more, it could be another in a long line of embarrasments.

Am I wrong in thinking that judges dont look kindly on fishing expeditions that end up not finding anything?

Emails and other communication between the Project Stockholm members and the lawyers for them might be very elucidating. If the lawyers communicated strategy, that is conspiracy and not subject to the atty-client privilege. I've been saying for a long time there are some private arrangements about the various litigations and positions. Proving it, however, may be nigh until impossible.
