An even closer analogy are the laws prohibiting interracial marriage. These laws were enforced, not only with the state not recognizing such marriages as may be the case today with gay marriage, but with jail sentences usually enforced against the black partner. When the black partner was the male, lynchings were occasionally applied in liew of jail. If this similarity were better known, perhaps the next referendum against gay marriage would get less support from African-Americans.

Basically those things became fundamental rights through constitutional Amendments.
