I get it, thanks...do you think COMS has hit bottom? It sure has done the opposite of what I would have thought it would have done considering it announced a short fall...it is back to a higher level than before it made the announcement...go figure...

Craig, do you think the class action lawsuit has a chance?

Here are the facts as I am aware of:
1. USR stopped shipping modems in the two months ended in May. This resulted in a substantial loss of revenue and earnings.
2. Coms reported this six months later in November in the SEC filing.
3. It reported in a footnote. They did nothing to notify the public.
4. In the interim between May and Nov., insiders sold heavyly.

If there are no other counter evidence, I would say COMS is quilty of misleading the public, making illegal insider trades.

But guess who will be paying the damages? Not those responsible. It will come from the shareholders.
