psst! hey tech, I think you forgot to bold this part:

This is also what I got from the NASDAQ gentleman, and it seems that the open investigation certainly can be detrimental to the listing process. He couldn't say that it WOULD prevent a listing, but he also couldn't say that it would NOT prevent a listing. He was very clear on that point as I kept trying to pin him to a statement.

The open investigation will absolutely be a factor.
I posted that I don't believe they'll get the listing while the review is open.

You were proved wrong by virtue that you've posted several times that the investigation had NO BEARING on the listing outcome. However, the proof is in the pudding, as they say in MA. The timetable for listing is near, and if they don't get it then, we have to conclude that the investigation was responsible, or a factor at least.

psst, I think you got a SAFETY instead!

PS., you'd do well not to combine my statements with angel's. It makes you look like you're trying to confuse angel with me--ie., I never said the things angel said. If you're going to quote, you need to get it right. Good luck at that!
