Even though the judge is a very intelligent man, and DOJ has a great experience on legal issu, MSFT will walk out of Court with no harm. According to "the tougher the words, the weaker the action", all the tough exchange during the hearing indicates a compromise and soft action.

Judge Harold Greene went pretty far out on a limb.

The courts have the power to construct the proper
solution to the problem and the history of this
country has pretty much proved them to be effective.

Are you saying there is no problem to be solved?
No abuses to be remedied?

I agree, Jerry. Microsoft isn't looking to good for this case, but it looks to me (though I am not expert) like they have a lot of solid grounds for appeal.

I don't get why Lessig remains on the case. If there is any question of his impartiality, I would think that the judge would boot him to avoid all the headache that his presence would cause.

As for the judge, why is he being so openly hostile towards Microsoft, or is this sort of thing common/accepted that I don't know about? Seems as though he's just adding more juice to Microsoft's appeal.

I ma actually surprised the judge worded his decision the way he did. It certainly does not take much imagination to consider someone who conspires to sue another party to be less then impartial in dealing with that party. I think the judge may be letting the media's take on MSFT's actions influence his judgement.
