Charles: I wondered the same thing. I also noticed that the most recent (3rd Qtr) financial report in January contained a "Forward Looking Statements and Risk Factors" section that was very complete, lengthy and specific, while similar statements for both the 1st and 2nd Qtrs in July and October were only one paragraph each--with a note referring readers to the FY97 10K report. On the surface that's ok, but all quarterly statements the previous year contained comprehensive "risk factor" sections.

Why the short shrift to FY 1st and 2nd quarter risk statements? Curious but not necessarily damning. In fact, if there was a conspiracy to bilk shareholders and line management's pockets, it would have been smart cover for the scheme to ensure risk statements were included in all releases. I think most investors merely breeze past those things anyway. Wouldn't have hurt the stock price.

Guess we'll have to let the lawyers fight this one. Unless the company settles--not likely, if you believe its claim the suits are without merit--there will probably be an intrusive look at its records that would reveal the extent it knew (if at all) long in advance that earnings would not meet projections.
