DR. MILTON SCHMIDTZ :

I hope you won't be offended if I simply refer to you from now on as DMS. It will speed things up.

You post:

As for Lanza selling stock? It could have been over a year ago, a month ago or a week ago. In my opinion, it doesn't really matter. You ask why? If I were him,I would have walked along time ago. Imagine being a consultant to a company knowing that management has a lazy attitude about getting important filings filed on time. It would be very difficult for me to get up in the morning, go into my office and work in an optimistic manner.

So, it's OK for JL to continuously bombard this thread, the telephone, and in person, anyone he can buttonhole and extol to the the sky the virtues of Xecom/Airstar...but, since HE personally was not optimistic it's alright to tout this stock then sell it himself? Well, it would be a novel defense to insider trading.

Let me know what the SEC says about it.

Wes

PS: Didn't JL disregard the fabulous deal since in fact one was never made? The only offer was the one by Dennis Casey, which JL accepted.

DMS,

A point of clarification. The AirStar 10-K is not two years delinquent, but rather about 5 1/2 weeks, and about 2 weeks for the first quarter 10-Q. Nevertheless, it is true that Xecom/AirStar has an inexcusable two-year history of filings financial reports late, sometimes months late. So the late 10-K might have to do with the wheelings and dealings of Mr. JL, but it might just be another chapter in the sad history of a company that files late all the time because its management just doesn't care about the shareholder. TJS

Mr. Schmidtz, Did you really have to call your CPA to find that information out? It sounds to me like you should not be involved in penny stocks at all. I hope he sends you a bill for interrupting his private evening time to answer a question that should be well known to someone with "40 years experience." You certainly have an interesting array of "favorite" stocks. Honeywell, Texaco, IBM, Airstar Technologies. I would be truly interested in what your CPA thinks of you dumping a large portion of your retirement money into this company.
