Smoking in bars is imho a reasonable subject for a plebiscite. The rescission of an article of the Bill of Rights is not. The paradox is this: even in an apparently unfettered republic, there are some things which should not be risked on a vote. That's what the Constitution is for - to nail down the things that we'll accept and uphold as political axioms.
