The privilege is based upon the notion that it is important for a
client to be able to speak freely with his lawyer.

From society's prospective, why is it important for a client to be able to speak freely with his lawyer?

What's interesting is that California has never had the attorney client privilege after one dies and it hasn't seemed to have caused any undue hardship or embarrassment. After all Vince Foster could have been subpoenaed to give this testimony but since he's dead now they can silence him forever. Would seem to provide a motive to permanently silence some people.
