Won't Confirm Commission Faxes On MCI, WorldCom June 18, 1998 8:43 AM BRUSSELS (Dow Jones)--The European Union Commission Thursday refused to confirm that it had queried competitors and other interested parties on proposed changes to the planned merger of telecommunications companies MCI Communications Corp. (MCIC) and WorldCom Inc. (WCOM) The Wall Street Journal Europe reported Thursday that the Commission had sent faxes out asking for comments on whether there would be any remaining overlap between WorldCom and MCI if MCI sells the rest of its Internet business, including customer lists, and intranet business and associated services such as secure-mail systems. The faxes reportedly also asked about no-compete provisions which would either prevent MCI and WorldCom targeting customers mentioned on the lists or, more stringently, turn away any of those customers who approached them. MCI announced several weeks ago it will sell its internet assets to Cable & Wireless Communications PLC (CWZ), but Competition Commissioner Karel Van Miert said this doesn't meet all his antitrust concerns. It is common practice for E.U. regulators to give competitors a chance to comment on any proposition made by merging companies to gain regulatory approval. Van Miert has recommended that E.U. member state antitrust officials oppose the merger when they vote on it Friday. Their opinion, which is non-binding, will go to the full 20-member Commission, which must make a decision by July 15.
