It is too bad Brad didn't use a more concrete example of misinformation in his complaint to the SEC. There is probably nothing actionable in a person saying he can manipulate a market (individually not believable) or in being short. However, if Valuespec has voiced some negative untruths regardless of being short, those would certainly spark someone's interest either at the company (as has happened, not necessarily regarding him) or at the SEC. 246810
