Yes, it may take five years, but that doesn't mean that Ericy et al. can't sell W-CDMA equipment. Remember, to prevent Ericy et al. from selling W-CDMA infrastructure, the Q has to get a preliminary injunction against Ericy et al. That is extremely difficult to do in a patent infringment case, where many issues can be brought up.

First off, W-CDMA is no more of a pipe dream than is CDMA2000. Secondly, it is market share. Which standard has the greater market share, TDMA/GSM or CDMA(IS-95)? That answer is TDMA/GSM. Now, if the ir customer's demand it, you will see a switch from CDMA(IS-95) to W-CDMA.

Qcom has done very well in the courts. They seem to have a competent legal team. They are up to the task. There are number of ongoing cases right now, where Qcom is involved, and it doesn't seem to have any negative effect on the company.

Make up your mind, do past results indicate future sucesses? Not even mutual funds say that. Anything could/can happen in court.
