What about the threat of AOL & NSCP combination to
MSFT 's IE and its internet presence.
What about the threat of Sun buying netscape 's software
business and leverage that against MSFT ?
You MSFT investors are too enamored with the stock due
to its
past performance.Those days are over,IMHO.

Here!!Here!!! U R right on then that Judge can call in AOL and talk about Monopolies!!! I believe all these computer internet guys and gals need to go into the Court and start singing "WE R THE WORLD..." real loud and get that case dropped so we can GET ON WITH IT !! Let the feds deal with the Impeachment hearings and GET OUT OF FREE ENTERPRISE before they REALLY SCREW it up!!! And I would really like to see an alliance with SEEK and the new disney Go site!!!

I think after Monday's announcement, the DOJ's case against MSFT brought about by NSCP is over.
Why?

1) NSCP did not exist as a company, and there is no base anymore for DOJ to
fight against MSFT. There is no reason for DOJ to ask MSFT to market
the NN which will have a very big distribution channel through AOL's
existing market.

2) NN ( From new AOL) + Java ( From SUN) + AOL's distribution channel means
a big threat to MSFT, so, it is MSFT who got hurt , not the old NSCP.

3) MSFT will rearm itself to face the fierce competition from New AOL + SUN,
and probably will think of buying Yahoo. Yahoo can not compete alone
against AOL + SUNW, and will probably accept the offer.

And the timing of the announcement of the AOL SUNW NSCP deal is very interesting, right after the ruling of the SUNW vs MSFT case !!!!!!!!

Paul,

I would have to dispute your thoughts on the NSCP/AOL impacts to the DOJ case.

The DOJ is using the NSCP/MSFT browser war as the primary evidence that MSFT has (past-tense) violated the anti-trust laws. So, the fact that NSCP and AOL are merging is a moot point.

Also, even though NSCP is merging with AOL, the browser war is still an issue. Now the problem has become AOL's problem with MSFT. A remedy is still needed. I would think AOL is not going to throw away the NSCP browser.

Based on this, this does not effect the DOJ case in the least. The issue still needs to be resolved - MSFT broke anti-trust laws.
