I have noticed this behavior but to a very minor degree with dlj.
If i put a limit order in, it fills 1/16 of a point beyond it, in either direction. I'll take a 1/16 hit anytime over a couple of points. My advice then, is switch to DljDirect. It also has a great web site.

>>IMO people are being robbed but the question is, who is guilty? ameritrade or the market maker? <<

Well the MM's have like 60 seconds before they even need to look at your quote. So if there is a lot of people ahead of you that can take a while. This is where going directly to SOES/ISLD/TNTO/INCA/BTRD etc pays off. Rather than letting the MM's work your order in their favour you work your own order. I strongly encourage anyone doing more than a few trades a week to sped the 300-500/month to get direct executions. Just saving you the spread on that one trade usually pays for the entire year. Or get a broker like Yammer. I am not sure what attracts people to el cheapo crap like ETurd I mean ETrade or Datek which locks you out during any day with more than 200 point swings. The $10 or $20 you spend with them actually is costing your 1000's!

Paul did you speak with a trade supervisor or manager? I had the same problem with PTVL - I bot 2k shares at market when it was 15 7/8 and they filled 10 mins later at 16 1/4. I talked to them and I also had the screen prints of my order, and they said they would correct the price to 16. However I haven't seen it in my transaction history yet, so they could be lying...

I had an issue with ETrade a couple of weeks ago that cost me dearly. As usual E*trade was running very slow. I was tring to get an order executed as prices were going up. E*Trade was not executing and occasionally I would get an Insufficient funds message. So I would cancel the order check the account - Plenty of funds... Put in another order ... Well I ended up putting in 2 orders - I'm guessing one of the orders I canceled was already executed but there servers were so slow in notifying me I didn't get a notice. Anyway I had sold off one position at a profit then the stock dropped about 30% and I was notified by Etrade that they were calling my second transaction back. Had I known I even had them I'd sold out at a profit with the other shares but as it was I ate it. Not a happy camper.
