I also saw something about this. I'll try to dig it up, but I seem to remember that the purpose was to limit competition with the cable system providing ATHM. In other words, they don't want you downloading Gone With The Wind or WWF Wrestling from someplace, when the cable company could be charging you for a premium channel, or a pay-per-view deal, for the same content.

Read the SEC Filings for athm, this is a real limit, and it
is old news. Start at:

I believe the intent is that ATHM will not compete w/ cable-provided
movies. As a soon-to-be ATHM subscriber, and a stockholder, I
could care less about this limit. I don't think most web users
will avoid subscribing to ATHM because of this limit. Speed wins.
