Tony:

the music industry is like a spoiled brat that used to be the kid with all the toys. Suddenly there's a new toy in town and he wants to squash it.

They can't do it. Every college campus in this country has hundreds of kids creating playlists on their PCs, with much of the music ripped from pirate sites. The industry has robots working 24X7 finding and shutting down these sites, but the genie is out of the bottle. They tried to stop Diamond Multimedia (DIMD) from selling the RIO, but lost, so MP3s are now portable as well. "MP3" is supposedly the 2nd most often entered search word, after "sex".
