To all, The following post was titled "Legal Notice" and made by the alias DCumming_55 Mar 25 1999, 9:25PM EST on the yahoo thread. My response will follow in a subsequent post. Those who wish to read the posts of others (and there were many) can follow the following link: post.messages.yahoo.com post.messages.yahoo.com@m2.yahoo.com Hit "view replies" at the bottom of the post. ************ To Whom It May Concern: It has come to the attention of Thermo Tech(tm) that this bulletin board is being used by some individuals to conduct an orchestrated campaign of libel and defamation against Thermo Tech(tm) and its current management. Many postings on this site contain outrageous and false allegations against management generally and against particular individuals. Thermo Tech(tm) and its management support this forum as an arena for frank and true discussions. However, a number of individuals have abused and continue to abuse this forum to publish untrue statements and defamatory innuendo. This posting is to serve notice to all that the patience of Thermo Tech(tm) and its management with these scurrilous postings is at an end. Thermo Tech(tm) has already commenced legal proceedings in the Supreme Court of British Columbia against certain named individuals. Thermo Tech(tm) has also delivered a formal "cease and desist" demand to individuals who have been identified to date. All future postings may be reviewed for their honesty. Any defamatory remarks posted by any person will be the subject of swift and vigorous action by our solicitors. If required, we will seek appropriate relief from the courts of any jurisdiction to have internet service providers disclose the identities of posters so that appropriate action may be taken in that jurisdiction. We encourage all posters to frankly express their views on all matters they feel concern Thermo Tech(tm) and its shareholders. So long as posters are able to contain their remarks to what is true, Thermo Tech(tm) will have no cause to intervene. If any reader is concerned by any information posted at this site, we invite you to contact us directly so that we may respond to your concerns with true facts. If any person has information of defamatory statements being made by any individuals orally, in writing or on the internet, please contact us so that we may speedily deal with those people, who for whatever reason, believe that they may lie about Thermo Tech(tm) with impunity. Dr. Cumming, I am not surprised. Over the past few years, I have been trying to determine what you and the others on management have been doing with your time as it has obviously not been building shareholder value. It is quite clear that Thermo Tech, on almost every method of valuation, is overvalued as a direct result of what appears to be multiple self serving actions of management. I do not find that it is surprising that a company that has been unable to carry through on its promises to shareholders must now resort to such tactics. I look forward to the day that you sir are singled out as a director and member of management in a class action lawsuit. The boiler room tactics you have used and condoned both a member of management and as a director have been at the very least unethical and immoral. Over the coming weeks, I give you notice that I, as well as undoubtedly others, will not cease to remind readers of the past releases you sir have signed and/or condoned. Your failures to shareholders are not few but many -- the sole difficulty will be in choosing which to bring back to light. The blame for plummetting shareprice while management has profited obviously does not rest with one man. You sir are equally to blame. My actions and I am sure as those of others will be a direct result of your post today -- I trust you are prepared for the result. Your promises of yesterday will be brought to light as well as your promises for the present -- they will be carefully analysed for what you call "the truth" -- a term that you appear to have loose definitions of. I am surprised you had the audicity to post for a man who along with Rene Branconnier is unafraid of being in open defiance of court and the laws of the land. If you are unafraid today, when the lawsuit(s) does come to pass, I hope you are prepared for having all your actions scrutinized. Justice will be served. I do not believe that you sir have the respect for the law that you have advocated. Your comments strike me in the very least as comical, in the worst as cynical and hypocritical. I look forward to the day when you and your "management team" can no longer do any more harm. Yours very truly, Clement
