"o Developments in patent litigation in which we are a defendant, particularly to the extent that adverse developments in these proceedings render certain of our patents invalid or unenforceable, which would reduce the scope of proprietary protection available to us and could limit our ability to collect license fees from sellers and users of laser vision correction equipment, which could have a material adverse effect on our business, financial condition and results of operations;"

Is this filing recent?
Do we have a time frame for this issue to be resolved?

The upcoming FTC ruling has nothing to do with the fees which are perfectly legal. These posts suggest that VISX may not be able to collect fees next week if something happens and that is far from the truth. VISX will be able to continue to collect until 2006 no matter what. I suggest if people don't do their due diligence to understand this issue, review the last conference call when this was discussed at length, then avoid this stock because it requires a little effort to get it straight in which case you will relax. See Bloomberg post below.
